It has long since been an American tradition to give due process in the court of law; you know the classic standard of being ‘innocent until proven guilty.’ The rule is one that makes our nation vastly different from so many others and why millions from around the world look to America as a country that is actually free.
And you would think that as a man who is very near to winning the Democratic nomination and possibly becoming president of the United States, Joe Biden would appreciate that standard more than most, especially since he has a sexual assault allegation hanging over his head. After all, he has touted to the masses that he should be believed, that his word should be taken as truth.
However, he made it clear this week that anyone else in the same situation, shouldn’t be given that same courtesy.
The U.S. Department of Education’s Secretary Betsy DeVos announced on Wednesday a change to the current policies surrounding sexual assault charges on college campuses. Basically, the change means that every student, whether they are the accused or the accuser, will be given fair and equal to make their case known and for it to be investigated.
According to CBS News, “DeVos’ policy adds new measures intended to make sure students accused of sexual misconduct are judged fairly in campus disciplinary hearings. Students on both sides must be given equal access to evidence gathered in the school’s investigation and be allowed to bring an adviser, which can be a lawyer, to the proceedings.”
Sounds fair, right? I mean, if we are going to be a country who claims to give due process, then we actually should.
Under the previous rules implemented during the Obama administration and with a significant push by then-vice president Joe Biden himself, colleges that receive federal funding could process allegations by assuming the opposite, that the accused was guilty until evidence proved otherwise.
However, few college students put in those situations were ever given a fair trial, let alone the chance to defend themselves. They were simply labeled as guilty, having their name, reputation, and future irreparably destroyed by nothing more than an allegation.
As contributing editor Emily Yoffe wrote in a Politico piece last year, “The accused were to be judged under the lowest standards of evidence, the definitions of misconduct were widely broadened, third-party reports could trigger an investigation even if the alleged victim did not think there had been a violation, and more.”
Therefore, it has been a priority of Devos and others for quite a while to have this policy reversed, giving both sides the ability to make their case fairly.
But Biden isn’t happy with this turn of events.
He remarked after the announcement was made on Wednesday that if elected president, he would most definitely reverse this, as he believes it is “an effort by the Trump administration to ‘shame and silence’ survivors of sexual assault,” according to The Hill.
Biden said, “It’s wrong. And it will be put to a quick end in January 2021, because as president, I’ll be right where I always have been throughout my career – on the side of survivors, who deserve to have their voices heard, their claims taken seriously and investigated, and their rights upheld.”
You know, just like Tara Reade deserves…
Now, I’m not saying that Biden is guilty. Nor am I saying that Reade is lying. As is the case with most sexual assault cases, it is a ‘their word against mine’ thing. And each side deserves to be given the same fair and equal consideration.
That is all DeVos is asking for, that both the accused and the accuser be given the right to plead their case, put forth evidence, and be heard on the matter.
And somehow, to Joe Biden, a man who currently stands accused and under his own line of thinking should be tarred, feathered, and run out of town, it’s all “wrong.”
I don’t know how you could be more hypocritical than that. Biden expects to be given fair and equal treatment, to be taken at his word when he is accused of a damning sexual assault with new evidence being released by the day. And yet, when some young person just starting out in life on their own, typically a man, gets accused of the same thing, he is to be thrown to the wolves. Truth be damned.
And this is the man Democrats want in the White House?
